GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale ("GTC") govern sales made on the ARCHIBEL website between ARCHIBEL and any person making a purchase on the site.
By placing an order, the customer acknowledges having read these GTC and accepts them without reservation.

2. PRODUCTS
ARCHIBEL offers swimwear, beachwear, and accessories for sale.
The essential characteristics of each product are presented on its product page.
Photographs are taken to represent the products and their colors as faithfully as possible. Slight variations may nevertheless appear depending on the lighting, shooting conditions, or the settings of the screen used.
Products are offered within the limits of available stock.
In the event of exceptional unavailability of a product after an order has been confirmed, the customer will be informed as soon as possible and will be reimbursed for the amounts paid for the product concerned.
3. PRICES
Prices displayed on the website are indicated in euros (€).
As ARCHIBEL is currently under the VAT exemption regime, VAT is not applicable in accordance with article 293 B of the General Tax Code.
Delivery costs are not included in the product price, unless otherwise stated. They are indicated to the customer before the final validation of the order.
ARCHIBEL reserves the right to modify its prices at any time. However, products are invoiced at the rate displayed at the time the order is confirmed.
For deliveries outside the applicable tax territory, customs duties, local taxes, or import fees may be requested upon receipt of the package. When applicable, these costs remain the responsibility of the recipient.
4. ORDER
The customer selects the products they wish to purchase and adds them to their cart.
Before confirming their order, they must check the selected products, sizes, quantities, delivery address, and all communicated information.
The order becomes final after payment validation.
An order confirmation is then sent to the customer by e-mail.
ARCHIBEL reserves the right to refuse or cancel an order in the event of suspected fraud, payment default, obviously incorrect information, or a previous dispute relating to the payment of an order.
5. PAYMENT
Payment is made at the time of order by one of the payment methods offered on the site.
Available payment methods are displayed when placing the order.
Transactions are processed by the payment providers offered via Shopify, and the customer's banking information is not directly stored by ARCHIBEL.
The order will only be considered validated after payment confirmation.
6. DELIVERY
ARCHIBEL offers delivery in metropolitan France, Guadeloupe, and other destinations available at the time of order.
Delivery methods, rates, and the applicable delivery date or period are indicated to the customer before the validation of their order.
ARCHIBEL undertakes to deliver the order within the time indicated at the time of the order. Failing any indication of a delivery date or period, the order will be delivered without undue delay and at the latest within thirty days following the conclusion of the contract, in accordance with applicable regulations.
In the event of late delivery, the customer benefits from the rights provided for by the Consumer Code.
The customer is responsible for the accuracy and completeness of the delivery address provided when placing their order.
In the event of a package being returned to ARCHIBEL due to an incorrect or incomplete address, an unclaimed package, or an impossibility of delivery attributable to the customer, any costs of a new shipment may be charged to the customer.
For international deliveries, delays may notably be affected by customs formalities independent of ARCHIBEL.
7. RIGHT OF WITHDRAWAL AND RETURNS
In accordance with the provisions of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.
To exercise this right, the customer may contact ARCHIBEL at contact@archibelswim.com by indicating their name, order number, and the items concerned, or by sending any other unambiguous statement expressing their wish to withdraw.
The customer may also use the standard withdrawal form below, though its use is not mandatory.
After informing ARCHIBEL of their decision to withdraw, the customer has 14 days to return the items concerned.
Return shipping costs are the responsibility of the customer.
Returned items must comply with the return and hygiene conditions specified in the "Shipping & Returns" section of the website.
In the event of exercising the right of withdrawal, ARCHIBEL will refund the amounts due, including initial delivery costs up to the cost of the standard delivery method offered, under the conditions and within the deadlines provided by the applicable regulations.
ARCHIBEL may defer the refund until the returned items are recovered or until receipt of proof of their shipment, the date taken being that of the first of these events.

8. DEFECTIVE OR NON-CONFORMING PRODUCT
Each ARCHIBEL item undergoes a quality check before shipment.
If the customer notices a defect, a product error, or an apparent problem upon receipt, they are invited to contact ARCHIBEL promptly at contact@archibelswim.com, specifying their order number and attaching, if possible, photographs to identify the problem.
This request will allow ARCHIBEL to address the situation as quickly as possible.
This commercial procedure in no way limits the rights that the consumer benefits from under legal guarantees.
9. LEGAL GUARANTEES
Products sold by ARCHIBEL benefit from applicable legal guarantees, notably the legal guarantee of conformity provided for by articles L.217-3 and following of the Consumer Code and the guarantee against hidden defects provided for by articles 1641 and following of the Civil Code.
The legal guarantee of conformity can be implemented within a period of two years from the delivery of the product, under the conditions provided by law.
In case of a lack of conformity covered by this guarantee, the consumer benefits from the solutions provided by the regulations, notably repair or replacement when these are possible, or, in cases provided by law, a price reduction or reimbursement of the product.
Deteriorations resulting notably from improper use, failure to follow care instructions, an accident, or normal wear and tear do not constitute a lack of conformity attributable to ARCHIBEL.

10. PRODUCT CARE AND USE
To best preserve the colors, materials, and shape of ARCHIBEL swimsuits, customers are advised to follow the care instructions on the product labels and on the "Care" page of the website.
Wear or deterioration resulting from inappropriate use, failure to follow care instructions, abnormal contact with abrasive surfaces, or any other cause external to the product does not necessarily constitute a lack of conformity.
11. LIABILITY
ARCHIBEL cannot be held responsible for damages resulting from improper use of the product or failure to follow care instructions.
ARCHIBEL cannot be held responsible for any delay or non-performance resulting from an event of force majeure under the conditions provided by French law.
However, these provisions cannot have the effect of excluding or limiting liability that cannot legally be excluded or limited with regard to a consumer.
12. INTELLECTUAL PROPERTY
All elements present on the ARCHIBEL website, including texts, photographs, videos, graphic creations, patterns, designs, logos, names, visuals, and brand identity elements, are protected by applicable intellectual property rights.
Any reproduction, representation, exploitation, or use, in whole or in part, without prior authorization is prohibited, except in cases authorized by law.
13. PERSONAL DATA
Personal data collected during the use of the site or the placement of an order is processed in accordance with applicable regulations.
Information regarding the collection, use, and user rights concerning their personal data is detailed in the Privacy Policy accessible on the site.

15. CONSUMER MEDIATION
In accordance with the applicable provisions of the Consumer Code, the consumer may resort free of charge to a consumer mediator for the amicable resolution of a dispute with ARCHIBEL, after having first sent a written complaint to ARCHIBEL.

16. APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law.
In case of difficulty, ARCHIBEL and the customer are invited to first seek an amicable solution.
When the customer is a consumer, the mandatory rules relating to jurisdictional competence and consumer protection remain applicable.
